Read the State Department rules about dual citizenship. If one parent is American and one is Canadian and child is born in America, then American citizen with application for dual citizenship to Canada (which is easier to get). If child's parent is American and the other is Canadian and child is born in Canada, child is Canadian and can apply for citizenship to US. This is harder to obtain. Came from the rules of the State Department. Dual citizenship isn't a given anymore so unless state department has their facts wrong, child does not automatically have dual citizenship but has to apply for it. And, US still does not totally recognize dual citizenship anyway. Obviously, the US government doesn't give out dual citizenship. So far as I know, no country gives out dual citizenship, because no country that I know of gives out citizenship to another country. However, people can be recognized as citizens by two countries (or more). That is dual citizenship. The state department website agrees with what I'm saying. In the first paragraph of the state departments website, it explicitly says a person can automatically have citizenship/nationality: Persons may have dual nationality by automatic operation of different laws rather than by choice. (source) This is true for Peyton Burns. She is a US citizen because she was born in the US, (INA 301 (a)) She is a Canadan citizen because Brent Burns was born in Canada. From the Canadan government website: people born outside Canada to a Canadian citizen on or after April 17, 2009, are Canadians at birth only if one of their parents was born in Canada. (source) This would also be true had Peyton been born in Canada. She would have been a Canadian citizen by being born in the country. (source) She would be an American citizen because her mom is one (INA (e)) The state department even uses the example of a person being born to a US citizen in a foreign country as to how someone might have dual citizenship. a child born in a foreign country to U.S. citizen parents may be both a U.S. citizen and a citizen of the country of birth. (source) Like I said before. Peyton Burns had dual citizenship the second she was born. |

I'm not sure what the guidelines are if the baby is a dual citizen. All I know if that her dad is Canadian, her mother is American and she was born in the US. I would assume she's American. |

They are most certainly married...you can choose to not believe it...but you're going to be wrong. =) They got married on Wednesday...I THINK it was in Texas...not completely sure though. |
